Affiliate Terms Of Use

By signing up as an affiliate for the Perfect Hair Health Membership Community, you agree to our Terms Of Use as outlined below. For questions, please email rob[at]perfecthairhealth.com.

Definitions:

  • “You” is synonymous with “Affiliate”
  • “We” and “Us” is synonymous with “Perfect Hair Health”
  • “Parties” refers to both “You” and “Us”
  • “Agreement” refers to this document (i.e., our entire “Terms Of Use”)

Purpose

You are entering into an affiliate agreement between yourself and Perfect Hair Health. This entitles you to a commission for customers that you refer to our site. An expansion of what this means is detailed below.

We are very selective with who we allow to promote our products, and how those products are promoted. For these reasons, affiliate arrangements are on an invite-only basis.

Referral Arrangement

As an affiliate, you are given a personalized affiliate link to the Perfect Hair Health Membership Community (i.e., my.perfecthairhealth.com). You can share this link however and with whomever you’d like, so long as:

  • You share your link through materials that you own (i.e., your own website or newsletter)
  • You don’t share your link on public forums (i.e., HairLossTalk.com, BaldTruthTalk.com, Reddit, etc.)
  • You adhere to our Advertising Principles (see “Advertising Principles” below).

If someone clicks on your affiliate link, a cookie will be set in their browser. That cookie will remain active for the next 60 days (so long as that visitor does not clear their browser’s cookies).

If, over the next 60 days, this visitor purchases any package from the Perfect Hair Health Membership Community (i.e., Complete Membership or Consulting Package), you will receive a commission for that sale.

Commission structures vary based on what was agreed upon, in writing, between you and Perfect Hair Health over email exchanges (see “Commissions”).

Commissions

Commission values are agreed upon before the time of your signup, and are arranged through email exchanges by the inviter of the affiliate. If you have more questions about this, please send us an email.

Most commission agreements are issued as a fixed fee, or a percentage, of the first sale made through a newly referred subscriber. However, in some written agreements, we may decide to offer you recurring commissions. This means if that visitor decides to (1) purchase one of our products, and then (2) continue with their subscription (i.e., accepting and paying their auto-renewal, which occurs every six months), then you will also receive a commission for each of their auto-renewals.

We track auto-renewals on a subscription basis, not a cookie basis. This means that you’ll receive credit for auto-renewals from the visitors you originally referred to us, even though these renewals technically fall outside of that 60-day cookie setting window.

Multi-Level Commissions

On occasion, we allow affiliates to sign up other affiliates. Think of the inviting affiliate as the “parent” affiliate, and the accepting affiliate as the “referred” affiliate.

In these cases, if the referred affiliate makes a sale, the parent affiliate will also receive a commission. This does not impact the commission percentages of the referred affiliate. Rather, it incentivizes select affiliates to work within their networks to find qualified affiliates that they can partner with to promote our site.

This is known as multi-level commissions. These commissions levels are agreed upon over writing between us, the parent affiliate, and the referred affiliate.

Self Commissions

You cannot refer yourself as a sale. In other words, if the email addresses match between your PayPal payouts and a new subscriber, we won’t pay you out for that commission. This is because this sort of practice is essentially like discounting your own membership, all by signing up through your own affiliate link.

Notifications

For each sale that you help to make, you will receive an email notifying you of the referred sale and the value of that sale to you (i.e., your commission). If possible, please keep these emails, as they’ll help you keep track of what to expect for each commissions payout period.

Payouts

Commission payouts are made on a monthly basis.

Commissions are paid out through PayPal bulk payments. As an affiliate, you’ll need to provide an email address to us that we can send money to via PayPal. When you receive a payment, you’ll get an email notification announcing that you’ve received money, and the value of that money – which you can then deposit into your bank account. This is the standard setup for most affiliate platforms for digital products, so if you’ve ever done affiliate work before, all of this should feel familiar.

However, it’s worth emphasizing that you absolutely must provide us with the right email address. If there is a typo in the email you’ve listed to receive payments, and we send a payment to that email, that money is irrecoverable to both us and you. We won’t resend that payment to you, because we’ll have already sent that money to some errant email address. So, before it’s time for you to receive any payouts, please quadruple-check that your email address is correct.

Also please note that commissions payouts are not instantaneous. We have a 30-day refund policy for all of our memberships. This is because we want people to feel good about the purchase they’ve made, and if they’re unhappy within their first 30 days of purchase, we don’t want their money. In other words, if they send us an email during this period requesting a refund, we will refund them 100% of their membership costs.

Because of this, we cannot instantly issue out commissions for all of your referred sales. Rather, we need to wait at least 30 days to ensure that your referred visitor does not request a refund during their eligible window.

For these reasons, we generally wait at least 31 days after a sale before sending out your commission for that sale. Rest assured you’ll receive payments for all of your tracked commissions, though it just won’t be instantaneous.

Link Redirects

When a visitor clicks on your affiliate link, a cookie will be set in their browser, and they will then be instantly redirected to one of the following off-site pages:

  • A sales page
  • An email course landing page
  • The registration pages of our products
  • A custom page as requested and agreed upon by you and Perfect Hair Health

These off-site pages act as sales funnels for the Perfect Hair Health Membership Community. Where you’d like to redirect your traffic is a matter of personal preference.

Some affiliates may prefer to send their traffic directly to our sales page (example here). This is usually the case when an affiliate’s promotional network (i.e., newsletter, website, etc.) may already have a high familiarity with Perfect Hair Health. In these instances, visitors may read the sales page, click any of the “buy” links on that sales page, purchase one of our products, and the affiliate will receive a commission for that sale.

Other affiliates may prefer to send their traffic directly to Perfect Hair Health’s free masterclass (example here), or to our free email course on hair loss and hair recovery. This often leads to higher sales conversions, particularly if an affiliate’s promotional network has less familiarity with the Perfect Hair Health brand. In these cases, an affiliate will reach a page with a specific call-to-action, like offering their email in exchange for free material. These visitors are then entered into an email sequence which, after gaining a reader’s trust over several value-driven emails, eventually pitches and promotes the Perfect Hair Health Membership Community (and well within the 60-day cookie window). If a purchase is made by one of your referred visitors, you will receive a commission for that sale.

Other affiliates prefer to link directly to our registration pages. We only recommend this if you are promoting a product as part of your own email sequence, are at the end of your sequence, and have already thoroughly educated your traffic on what our products are.

Finally, other affiliates prefer to have us setup a unique sales page altogether – one that might specifically call out a discount for their subscribers “i.e., ‘Special discount for Mark Z.’s subscribers ends in three days'”. We are happy to do this, provided that your newsletter list and/or website size warrants the time and energy needed for us to set this up.

You can email us at any time to request which redirect you’d like for your links. In the meantime, we default everyone to our free masterclass and/or email course – as that seems to have the best conversion rate for affiliates (even though a sale may often take up to 12-20 days to manifest).

Advertising Principles

Messaging

We want our affiliates to accurately convey our products for what they are: a membership site that helps people achieve hair recovery on their own terms – with or without drugs. We are evidence-based; we are community-driven; we are here to help hair loss sufferers find a pathway to hair recovery that fits with their needs, preferences, and unique hair loss case.

On that note, we are NOT a “miracle cure” for hair loss. We are NOT “the secret cause of hair loss that pharmaceutical companies don’t want you to know about”. We are NOT “the truth about hair loss that will change your life forever”.

We stand against companies that take advantage of desperate hair loss sufferers; we stand against BuzzFeed-style headlines, as well as sales pages that are untruthful, misrepresentative, and prey on the emotions that may come attached to what it feels like to lose hair.

So, during your promotion of our products to your subscribers, websites, etc., please honestly represent our products for what they are – for example, a membership designed to maximize your chances (and degree) of hair regrowth. Do not make false claims; do not misrepresent us. Failure to adhere to these principles may result in termination of this agreement (see “Termination”), with the degree of termination commensurate with the degree of violation in our policies, and as determined by us.

As always, we’re happy to help with this. We want to set you up for success as an affiliate, and if you need any clarification on what is or isn’t appropriate to say, please email us with your ad copy. We’ll get back to you and let you know if it fits with our own branding and ethos.

Link locations

Please only share affiliate links through online materials that you own (i.e., your own newsletter, your own website, and/or your own YouTube channel, etc.).

You are not allowed to share affiliate links on public forums, even if you own that public forum. This includes places like HairLossTalk.com, BaldTruthTalk.com, Reddit, etc. In general, public forums dealing with health- or appearance-related issues are just too negative to have a productive promotional effort; the efforts to manage user responses are not worth the few (if any) subscriptions earned. Moreover, linking in public forums puts us in a position where we have to immediately “defend” the integrity of our site to anonymous users who troll hair loss forum boards – many of whom are competitors trying to promote their own product. As an affiliate, you avoid this mess entirely by not sharing your Perfect Hair Health affiliate links in these forums.

Confidentiality

During the course of your time as an affiliate, it may be necessary for us to share proprietary information, including trade secrets, industry knowledge, and other confidential information, to you in order for you to seek out potential referrals.

You will not share any of this proprietary information at any time – even if you stop being an affiliate. You also will not use any of this proprietary information for your personal benefit at any time. To reiterate, this section remains in full force and effect even after termination of this Terms Of Use by either its natural termination or the early termination by either party.

Termination

This Terms of Use agreement may be terminated for any reason (and at any time) by either you or us, so long as written notice is provided to the other party. Upon termination, we’ll pay you out for your eligible compensation due and owing for referrals made prior to the date of termination but not yet paid.

After termination, we’ll continue to pay you out for your eligible recurring commissions. This is because we’re an honest business, and we want to compensate you for the efforts you’ve made to help us grow our business. However, there are circumstances that would disqualify you from receiving recurring commissions after termination, and they’re generally relegated to you doing something so egregious and/or damaging to our products and/or our reputation that we feel no desire to reward your bad behavior. Examples include but are not limited to:

  • Making claims about our products (in your messaging/advertising) that are illegal, disingenuous, misrepresentative, and/or create significant legal/public relations problems for us
  • Promoting other company’s products in our forums
  • Deliberately trying to damage our brand in any form – written, verbal, or otherwise

Again, we are an honest business, and we only want to do business with others who are aligned with the same degree of integrity. If you have any questions about what is/isn’t acceptable in terms of advertising our products, please ask first before proceeding. That way, we can avoid full terminations without recurring payouts and keep everyone happy.

Representations and Warranties

Both parties (you and us) represent that they are fully authorized to enter into this agreement. The performance and obligations of either parties will not violate or infringe upon the rights of any third-party or violate any other agreement between the parties, individually, and any other person, organization, or business or any law or governmental regulation.

Indemnity

The parties each agree to indemnify and hold harmless the other party, its respective affiliates, officers, agents, employees, and permitted successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result from the negligence of or breach of this agreement by the indemnifying party, its respective successors and assigns that occurs in connection with this agreement. This section remains in full force and effect even after termination of the agreement by its natural termination or the early termination by either party.

Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL EITHER PARTY BE LIABILE TO THE OTHER PARTY OR ANY THIRD PARTY FOR ANY DAMAGES RESULTING FROM ANY PART OF THIS AGREEMENT SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE OR ANTICIPATED PROFIT OR LOST BUSINESS, COSTS OF DELAY OR FAILURE OF DELIVERY, WHICH ARE NOT RELATED TO OR THE DIRECT RESULT OF A PARTY’S NEGLIGENCE OR BREACH.

Disclaimer of Warranties

Affiliate shall refer potential clients/customers as requested by Company.

AFFILIATE DOES NOT REPRESENT OR WARRANT THAT SUCH REFERRALS WILL CREATE ANY ADDITIONAL PROFITS, SALES, EXPOSURE, BRAND RECOGNITION, OR THE LIKE. AFFILIATE HAS NO RESPONSIBILITY TO COMPANY IF THE REFERRALS DO NOT LEAD TO COMPANY’S DESIRED RESULT(S).

Severability

In the event any provision of this agreement is deemed invalid or unenforceable, in whole or in part, that part shall be severed from the remainder of the agreement and all other provisions should continue in full force and effect as valid and enforceable.

Waiver

The failure by either party to exercise any right, power or privilege under the terms of this agreement will not be construed as a waiver of any subsequent or further exercise of that right, power or privilege or the exercise of any other right, power or privilege.

Legal and Binding Agreement

This agreement is legal and binding between the Parties as stated above. This agreement may be entered into and is legal and binding both in the United States and throughout Europe. The parties each represent that they have the authority to enter into this agreement.

Governing Law and Jurisdiction

The parties agree that this agreement shall be governed by the State and/or Country in which both Parties do business. In the event that the Parties do business in different States and/or Countries, this Agreement shall be governed by United States law.

Entire Agreement

The parties acknowledge and agree that this agreement represents the entire agreement between the parties. In the event that the parties desire to change, add, or otherwise modify any terms, they shall do so in writing as reflected in either email correspondences or here within the agreement itself.

From time-to-time, we will change this affiliate agreement. These changes will mainly surround updates to reflect changing legal landscapes and/or close loopholes that enterprising affiliates may expose. If the changes are substantial, you will be emailed. Otherwise, please note that for as long as you are an affiliate with us, you are obligated to follow the changes reflected in this document regardless of whether you were notified of them.
